1. Introduction

This Terms of Service ("Terms") is a legally binding agreement between Enoch Tech Services (referred to as "we", "us", "our", or "Stamping.my") and you ("you", "your", or "User"). These Terms govern your access to and use of our website, platform, APIs, software, and all related products and services (collectively, the "Services").

By accessing or using the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately discontinue use of the Services.

2. Scope of Services

Stamping.my provides cloud-based software and related solutions designed to assist you with:

  • License lifecycle management and compliance tracking;
  • Digital documentation, reporting, and data analytics; and
  • Customer communications, including notifications and SMS messaging.

Access to certain Services may require an active user account, valid subscription plan, or paid add-on. We may enhance, modify, suspend, or discontinue any aspect of the Services for maintenance, improvement, or business reasons, with reasonable notice where practical.

3. Eligibility and Account Registration

You must meet the following requirements to access the Services:

  • Be at least eighteen (18) years old and legally able to enter into binding agreements;
  • Provide accurate, current, and complete registration information;
  • Promptly update any information that becomes inaccurate or incomplete; and
  • Maintain the confidentiality of your login credentials.

You are responsible for all activities that occur under your account. We may suspend or terminate any account containing false information, being used in violation of these Terms, or suspected of fraudulent or unlawful activities.

4. Acceptable Use

You agree to use the Services only for lawful purposes and in compliance with applicable Malaysian laws, including the Communications and Multimedia Act 1998 and the Personal Data Protection Act 2010 (PDPA). You must not:

  • Transmit or promote unlawful, harmful, defamatory, harassing, or obscene material;
  • Infringe any third party's intellectual property, privacy, or proprietary rights;
  • Attempt to gain unauthorised access to any system, account, or data;
  • Interfere with or disrupt the integrity or performance of the Services;
  • Introduce malware, malicious scripts, or other harmful code;
  • Send unsolicited or deceptive communications, including spam;
  • Misrepresent your identity or affiliation; or
  • Attempt to bypass any of our usage limitations, security mechanisms, or service restrictions;
  • Use the Services in any manner that could damage or impair our infrastructure.

We reserve the right to monitor usage and suspend or terminate access if we reasonably believe your use violates these Terms, applicable law, or network integrity requirements.

5. Fees, Billing, and Payment

When using paid Services, you agree that:

  • Fees are payable in the currency and within the due date specified in your plan or order form;
  • All quoted fees exclude taxes, duties, or government charges, which you must bear;
  • Failure to pay may result in suspension or termination of access; and
  • Payments are non-refundable except where required by law or expressly stated otherwise.

6. Data Privacy and Protection

We process personal data in accordance with the PDPA and our Privacy Policy. By using the Services, you consent to our collection, use, processing, and disclosure of personal data as described in that policy.

You are responsible for securing all necessary consents from individuals whose personal data you upload or transmit through the Services. While we implement reasonable technical and organisational safeguards, you acknowledge that no system is entirely secure and agree to maintain independent backups.

7. Intellectual Property

All rights, title, and interest in the Services—including software, documentation, logos, trade names, and other materials—remain the exclusive property of Enoch Tech Services or its licensors.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your internal business purposes. You may not copy, modify, reverse engineer, distribute, or create derivative works based on the Services unless expressly authorised in writing. Feedback or suggestions you provide may be used without restriction or obligation.

8. Service Availability and Maintenance

We strive to deliver reliable, continuous Services but do not guarantee uninterrupted or error-free performance. Scheduled maintenance, updates, or upgrades may temporarily limit access. We are not liable for interruptions caused by factors beyond our control, including internet outages, third-party failures, or force majeure events.

9. Third-Party Services and Integrations

The Services may rely on or integrate with third-party software, APIs, telecommunications services, or payment processors. We are not responsible for the performance, security, or availability of those third-party services. Your use of them is subject to their respective terms and privacy policies, and any disputes must be resolved directly with the relevant provider.

10. Prohibited and Restricted Activities

In addition to the Acceptable Use requirements, you must not use the Services to:

  • Engage in fraudulent, deceptive, or misleading practices;
  • Send mass or unsolicited electronic messages without consent;
  • Disseminate offensive, discriminatory, or harmful content;
  • Violate regulations issued by the Malaysian Communications and Multimedia Commission (MCMC);
  • Impersonate any organisation, government entity, or third party; or
  • Circumvent usage limits, payment obligations, or security controls.

We may suspend or terminate your access immediately if we detect any prohibited conduct.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, special, or punitive damages—including loss of profits, data, or goodwill—arising from your use or inability to use the Services. Our total aggregate liability for all claims in any twelve (12) month period is limited to the total fees you paid to us for the Services during that period. Nothing in these Terms limits liability where prohibited by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Enoch Tech Services, together with our directors, employees, agents, and affiliates, from any claim, loss, liability, or expense (including legal fees) arising out of or related to:

  • Your breach of these Terms;
  • Your violation of applicable laws or regulations; or
  • Your data, content, or use of the Services that infringes third-party rights.

13. Suspension and Termination

We may suspend or terminate your access immediately if we reasonably believe that you have breached these Terms, failed to pay applicable fees, or engaged in unlawful activity. You may terminate your account at any time by written notice or ceasing use of the Services. Upon termination, your right to access the Services ceases immediately and we may delete your account data in line with our retention policy. Termination does not relieve you of obligations incurred prior to termination, including payment and indemnity obligations.

14. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis without any warranty, whether express, implied, or statutory. We expressly disclaim all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and do not warrant that the Services will meet your requirements or operate uninterrupted, timely, secure, or error-free.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or relating to these Terms is subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia. The parties agree to attempt to resolve disputes amicably before commencing legal proceedings.

16. Miscellaneous

  • Entire Agreement: These Terms, together with the Privacy Policy and any applicable order forms, constitute the entire agreement between you and us regarding the Services.
  • Amendments: We may modify these Terms by posting an updated version on our website. Continued use after changes signifies acceptance.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
  • Waiver: Failure to enforce any provision does not constitute a waiver of rights.
  • Assignment: You may not assign or transfer your rights or obligations without our prior written consent.
  • Notices: We may deliver notices electronically via your registered email or through the Services. You should keep your contact information current.
